Terms and Conditions

Please read these Terms and Conditions carefully before using SpotCheck. By creating an account or using our service, you agree to be bound by these terms.
1. About SpotCheck
SpotCheck is an online property information service operated by SPOTCHECK PROPERTY LIMITED, a company registered in New Zealand ("SpotCheck", "we", "us"), available at spotcheck.property and through the SpotCheck mobile app for iOS and Android (together, "the service"). SpotCheck generates automated reports covering environmental and locality factors such as air quality, noise, crime statistics, and demographic data for properties in the markets SpotCheck supports, across Australasia, Europe and the Americas. The markets we support change as new ones are added; the address search shows whether we can report on a given address.
2. Eligibility
You must be at least 18 years old to use SpotCheck. By registering, you confirm that the information you provide is accurate and that you are authorised to use the service on behalf of any organisation you represent.
3. Reports and their limitations
SpotCheck reports are generated using statistical models, publicly available datasets, and machine learning. They are provided for informational purposes only and do not constitute professional advice of any kind, including legal, environmental, health, real estate, or planning advice.
- Estimates are based on modelled data and may not reflect current conditions at any specific property.
- Data sources may be incomplete, out of date, or contain errors.
- Coverage, data sources, and the sections included in a report vary by country and location.
- Reports should not be relied upon as the sole basis for any property purchase, investment, or development decision.
- We recommend obtaining independent professional advice before making significant decisions.
4. Mobile app
SpotCheck is also available as a mobile app for iOS and Android. These terms apply to the app in the same way as the website, along with the following:
- We grant you a personal, non-transferable licence to install and use the app on devices you own or control. The Apple App Store and Google Play terms of service also apply to your download and use of the app. Apple and Google are not party to these terms, are not responsible for the app or its content, and have no obligation to provide support or refunds for it beyond their own store policies.
- Purchases made inside the app are processed by the Apple App Store or Google Play, see sections 6 and 10.
- Push notifications are optional. Report notifications and market alerts can be turned on or off in the app at any time, and news announcements are off unless you enable them. Turning notifications off does not affect anything else in your account.
- Location access is optional and is only used to position the map. The app is fully functional if you decline it.
- We release app updates from time to time and may require a minimum app version where older versions are no longer compatible with the service or secure to operate.
5. Credits and payment
Access to SpotCheck reports requires the purchase of credits or an active subscription (see section 6). Prices are set in New Zealand dollars and converted to your local currency where supported, the price shown at checkout is the price you will be charged. Payments on the website are processed securely by Stripe; purchases made inside the mobile app are processed by the Apple App Store or Google Play at the price shown in the store.
- Credits are deducted at the time a report is generated.
- Where you pay by card at the time of ordering a report, your card is authorised at checkout and the payment is taken only once the report has been generated. If a report fails to generate, the authorisation for it is released and you are not charged. Your bank may continue to show a released authorisation as pending for a short period. This applies to website orders paid by card; reports run against credits you already hold, a subscription allowance, or a purchase made in the mobile app are covered by the refund position in section 9.
- Credits belong to your SpotCheck account, not to a particular platform: credits purchased in the mobile app can be used on the website, and credits purchased on the website can be used in the app.
- Purchased credits expire 12 months from the date of purchase. Unused credits that expire are not refundable.
- When you run a report, credits are used in the following order: your active subscription allowance first (if any), then bonus credits, then paid credits by soonest expiry date.
- Credits have no cash value and cannot be exchanged for money, except as provided under our refund policy below.
- If you enable auto top-up, you authorise us to charge your saved payment method for the package you selected when your credit balance reaches zero. The price charged will be the then-current price for that package. If we change the price for a package, we will notify you by email at least 30 days before the new price takes effect. You may disable auto top-up at any time from your account settings. Auto top-up is available for website purchases only.
6. Subscriptions
SpotCheck offers monthly subscription plans that include a set number of reports per month. Subscriptions are currently purchased on the website; an active subscription applies to your account wherever you use it, including the mobile app.
- Plans renew automatically and are billed monthly in advance through Stripe, in your local currency where supported.
- Your monthly report allowance resets at the start of each billing cycle. Unused reports in your allowance do not roll over to the next cycle and are not refundable.
- If you upgrade to a higher plan, the additional allowance is available immediately. If you downgrade, the change takes effect from your next billing cycle and your current allowance is unaffected.
- You may cancel your subscription at any time from your account page. Cancellation stops future renewal charges; any purchased credits you hold are unaffected and continue to work as usual.
- If we change the price of your plan, we will notify you by email at least 30 days before the new price takes effect.
7. Credit sharing
SpotCheck offers two ways to share credits with other users.
Organisation sharing (same email domain): Users whose accounts share the same email domain (e.g. all staff at yourcompany.co.nz) automatically share purchased credits within that organisation. You can opt individual addresses in or out of organisation sharing from your account settings.
Invite pool: Any user may create an invite pool and invite others by email address. Pool members share purchased credits, any member can run reports using the pool's available balance.
- Pool membership is voluntary. You may leave a pool at any time from your account settings.
- Bonus and referral credits are personal and are not shared through any sharing arrangement.
- Only the pool owner can invite new members or remove existing members.
- SpotCheck is not responsible for disputes between pool members regarding credit usage.
8. Bonus and referral credits
SpotCheck may award bonus credits through referral programmes and promotions. These credits are subject to the following conditions:
- Signing up, with or without a referral link, does not award any credits. Reports are paid for with purchased credits or an active subscription.
- The person who referred you receives 1 bonus credit when you make your first credit purchase.
- Bonus and referral credits are personal to the account they are awarded to. They cannot be transferred, shared via a pool, gifted, or used by any other account.
- Bonus credits expire 12 months from the date they are awarded.
- Bonus credits have no cash value and are not refundable.
9. Refunds and consumer rights
If you are unsatisfied with a report, please contact us at [email protected] within 14 days of purchase. We will consider refund requests on a case-by-case basis. Credits purchased but not yet used may be refunded at our discretion.
Purchases made inside the mobile app are processed by the Apple App Store or Google Play, and refunds for those purchases are handled under the relevant store's refund policy. Contact us first and we will help where we can, but store refunds are decided and processed by Apple or Google. If a store refund is granted for credits you have already spent on reports, we may deduct the corresponding credits from your account balance.
Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 (New Zealand), the Australian Consumer Law, or any other consumer-protection law of the country where you live, to the extent it applies to you and cannot be excluded.
If you are a consumer in the European Union or the United Kingdom, you may have a statutory 14-day right to cancel an online purchase. By purchasing credits or a subscription you request immediate access to the service, and this cancellation right ends for any credits or allowance you have used to generate reports. If you cancel within 14 days without having used any of your purchase, we will provide a full refund.
10. Acceptable use
You agree not to:
- Use SpotCheck for any unlawful purpose or in a way that violates any applicable law or regulation.
- Attempt to reverse-engineer, scrape, or extract data from the service in bulk.
- Share your account credentials with others.
- Use the service to generate reports on properties for the purpose of harassment or discrimination.
- Attempt to circumvent any security measures, usage limits, or access controls.
11. Intellectual property
All content on SpotCheck, including the software, models, design, and branding, is owned by or licensed to SPOTCHECK PROPERTY LIMITED and is protected by New Zealand and international intellectual property laws.
Reports generated for you are licensed for your personal or internal business use. You may share a report, including its link, with people directly involved in the same property decision, such as household members, co-purchasers, professional advisers, or (if you are a real-estate agent) your clients and prospective buyers. Agents participating in the SpotCheck agent badge programme may display co-branded reports to their clients in accordance with the programme terms. You may not otherwise resell, republish, or mass-distribute report content without our written permission.
12. Account suspension and termination
We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or where we determine at our sole discretion that continued service is not appropriate. Where an account is terminated due to a policy violation, unused credits may be forfeited. Where termination is at our discretion and not due to any fault of yours, we will refund unused credits.
13. Limitation of liability
To the maximum extent permitted by law, SpotCheck's total liability to you for any claim arising from use of the service is limited to the amount you paid to SpotCheck in the 12 months preceding the claim.
We are not liable for any indirect, incidental, special, or consequential loss or damage, including loss of profit, loss of data, or loss arising from reliance on report content.
14. Disclaimer of warranties
SpotCheck is provided "as is" and "as available". We do not warrant that the service will be uninterrupted, error-free, or that any particular report will be accurate or complete. We make no representations about the suitability of reports for any particular purpose.
15. Privacy
Our collection and use of personal information is governed by our Privacy Policy, which forms part of these terms.
16. Changes to these terms
We may update these terms from time to time. We will notify you of material changes by email or by displaying a notice on the site. Continued use of SpotCheck after updated terms take effect constitutes acceptance of the new terms.
17. Governing law
These terms are governed by the laws of New Zealand, and you and we submit to the non-exclusive jurisdiction of the New Zealand courts. If you are a consumer, nothing in this clause deprives you of the protection of mandatory consumer laws of the country where you live, or of any right you may have to bring proceedings in your local courts.
